Yes its a HOA rule and I prefer not to make a issue out of it.
The 50 AGL was just my guess - this is a one story ranch with the garage attic used as the location for the transmitter. (Should I change the 50 to something less?)
Note there is a window in the garage (i think esthetics) that faces roughly north.
